Festival Terms & Conditions
By purchasing a pass, making a reservation, or attending any Viva Big Bend event, you agree to the following Terms & Conditions.
1. Agreement to Terms
Participation in Viva Big Bend constitutes acceptance of these Terms & Conditions. These policies apply to all festival participants, regardless of whether the reservation was made personally or by a third party on their behalf.
Viva Big Bend reserves the right to update or modify these Terms at any time. The most current version will be posted on the Festival website.
2. Payment Policy
Accepted forms of payment include credit or debit cards. Personal and business checks are not accepted.
For credit or debit card purchases, your statement will appear as “Viva Big Bend” and/or “Easol.”
If a payment plan is offered, the remaining balance must be paid by June 1st, 2026. Reservations with unpaid balances may be canceled, and any payments made may be forfeited.
Late payments may be subject to a 5% late fee after seven days past the due date.
3. Refund and Transfer Policy
All festival passes and reservation payments are non-refundable.
If you are unable to attend, you may request to transfer your pass to another individual. Transfers may be approved at the sole discretion of Viva Big Bend and may require a $100 transfer fee per pass.
4. Artist Lineup, Schedule, and Venue Changes
Festival artists, schedules, and venues are subject to change at any time.
Viva Big Bend does not guarantee the appearance of any specific artist or performance. Artist cancellations, lineup changes, scheduling adjustments, or venue changes will not be grounds for refunds.
5. Weather and Outdoor Event Policy
Viva Big Bend involves outdoor venues, and weather conditions may affect event schedules or locations.
Events may be delayed, relocated, paused, or canceled due to weather or safety concerns. The Festival will make reasonable efforts to continue programming when possible, but weather-related changes do not qualify for refunds or credits.
6. Participant Conduct
All participants are expected to behave responsibly and respectfully.
Viva Big Bend reserves the right to deny entry or remove any participant from Festival events or accommodations for behavior that is illegal, unsafe, disruptive, or interferes with the enjoyment of other attendees.
This includes harassment, violence, misuse of alcohol or drugs, or violations of venue or Festival policies.
Participants removed for misconduct will not be eligible for refunds.
7. Social Media and Public Conduct
Participants are expected to maintain respectful conduct both at Festival events and in online interactions related to the Festival.
Viva Big Bend reserves the right to deny participation or revoke event access for individuals who engage in harassment, threats, or defamation directed toward Festival staff, artists, vendors, volunteers, or other attendees.
8. Travel and Accommodations
Participants are responsible for arranging their own transportation to and from the Festival.
Viva Big Bend is not responsible for travel disruptions including flight delays, cancellations, lost luggage, or additional expenses related to transportation.
Festival packages may include accommodations or lodging arrangements with third-party providers.
Participants are responsible for any additional charges incurred during their stay, including but not limited to:
Room service
Parking fees
Damages or cleaning charges
Optional purchases
Viva Big Bend is not responsible for any such charges or disputes between Participants and lodging providers.
9. Alcohol Responsibility
Alcohol may be available at Festival events. Participants must be 21 years of age or older and may be required to present valid identification.
Participants who choose to consume alcohol do so voluntarily and accept full responsibility for their actions and safety.
Viva Big Bend reserves the right to refuse alcohol service and may remove any individual who appears intoxicated or behaves unsafely.
Viva Big Bend is not responsible for injuries, accidents, damages, or losses resulting from alcohol consumption. Participants are encouraged to use designated drivers, rideshare services, or other safe transportation options if they consume alcohol.
10. Photography and Media Release
By attending Viva Big Bend, participants grant the Festival permission to photograph, record, or film their likeness during Festival activities.
These materials may be used for promotional, advertising, or commercial purposes including websites, social media, and marketing materials without compensation.
11. Health and Safety Compliance
Participants agree to follow all health, safety, and security policies established by Viva Big Bend, Festival venues, local authorities, and event staff.
Failure to comply with safety procedures or emergency instructions may result in removal from the Festival without refund.
12. Assumption of Risk and Liability Waiver
Attendance at Viva Big Bend involves inherent risks, including large crowds, live music events, outdoor conditions, and travel.
By participating in the Festival, each participant voluntarily assumes all risks associated with attendance and agrees that Viva Big Bend, its organizers, employees, volunteers, sponsors, venues, and partners will not be held liable for any injury, illness, property damage, loss, or other incident that may occur.
13. Force Majeure
Viva Big Bend shall not be responsible for cancellations or disruptions caused by events beyond its control, including but not limited to severe weather, natural disasters, government restrictions, public health emergencies, civil unrest, or other unforeseen circumstances.
14. Limitation of Liability
If Viva Big Bend is found legally liable for any claim related to the Festival, damages will be limited to the amount paid by the participant for their Festival pass or reservation.
15. Severability
If any portion of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will remain in full effect.
